By renting a kayak from RiverRack and it's licenses you automaticly accept the terms below.

Kayak Rental Hold Harmless Agreement
1. Assumption of Risk
I, the undersigned renter/participant, acknowledge that kayaking involves inherent risks including, but not limited to, drowning, collisions, capsizing, personal injury, property damage, or death. I freely assume all risks associated with the use of the kayak and related equipment.

2. Release & Hold Harmless
I agree to release, indemnify, and hold harmless River Rack, INC, its owners, employees, agents, and affiliates from any and all claims, actions, damages, liabilities, costs, or expenses, including attorney’s fees, arising out of my participation in kayak rental and use, whether caused by negligence or otherwise.

3. Safety & Responsibility
I agree to wear a U.S. Coast Guard–approved life jacket at all times while on the water.
I agree not to use the kayak under the influence of alcohol, drugs, or impairing substances.
I am responsible for returning the kayak and all rental equipment in the same condition as received, reasonable wear and tear excepted.
I agree to pay for any lost, stolen, or damaged equipment.

4. Health Certification
I certify that I am physically fit, able to swim, and have no medical conditions that would prevent me from safely operating a kayak.

5. Governing Law
This Agreement shall be governed by the laws of the State in which you rented the kayak.

6. Binding Effect
This Agreement shall be binding upon me, my heirs, executors, administrators, and assigns.
